Following the adoption of the 2016 Paris agreement on climate change and the United Nations 2030 agenda for Sustainable Development Goals, the European Commission announced in the Action Plan: Financing Sustainable Growth (2018), the intention to clarify the integration of sustainability in so-called fiduciary duties in sectoral legislation.

In December 2019, the European Commission adopted its communication on a European Green Deal which significantly increased the EU’s climate action and environmental policy ambitions.

As one of Europe’s leading financial centres, Luxembourg plays an important role in mobilizing private and public capital, in order to assist governments and investors around the world to mitigate climate change. Luxembourg is the European leader in responsible investment fund assets, accounting for 34% of responsible funds across Europe and ranking among the top green financial centres in the global Green Finance Index published in 2020.

Pursuant to the regulation on sustainability-related disclosures in the financial services sector (the “SFDR”), financial market participants must comply with the high level and principle-based requirements as from 10 March 2021.

The regulation on the EU Climate Transition Benchmarks, EU Paris-aligned Benchmarks and the regulation on the EU taxonomy for sustainable activities are additional pieces of EU legislation aimed at transforming Europe’s economy into a greener, low-carbon, more resilient and circular-system.
